“I’m incredibly grateful to KRW Law Firm for taking on my car accident case and securing a settlement for the injuries my wife and I sustained. From start to finish, my attorney, Henry Wollam, was confident, knowledgeable, and professional—exactly what you want when you're going through a stressful situation. He clearly knew the process inside and out, which gave me peace of mind throughout. The entire staff, especially Genevieve, was also courteous, responsive, and professional every step of the way. Who Can Pursue a Wrongful Death Claim in Texas?
Texas law establishes who can file a wrongful death claim after a loved one’s death. The victim’s surviving spouse, children, or parents may file a claim, either individually or as a group. A child who was legally adopted is also eligible to file a claim based on an adoptive parent’s wrongful death, and adoptive parents may file a claim based on an adoptive child’s death. Siblings and grandparents cannot file a claim.
If there is no surviving spouse, child, or parent, the personal representative of the victim’s estate has the right to initiate a wrongful death claim. The personal representative can also bring a claim if no eligible surviving family member does so within three months, though surviving family members who would be otherwise eligible to file a claim can block the personal representative from proceeding with a lawsuit.
The personal representative is usually named in the deceased’s will. If there is no valid will or if the chosen personal representative does not take on the position’s responsibilities, the court will appoint a personal representative.
If you still have questions about who can pursue a claim on behalf of your deceased loved one, our San Antonio wrongful death attorneys can help. We can answer your questions and provide clarity on who can bring a lawsuit.
What Is the Deadline for Filing a Wrongful Death Claim in Texas?
Texas’s statute of limitations for wrongful death claims limits the amount of time that you have to bring a lawsuit after a loved one’s death. Generally, you must file the lawsuit within two years after your loved one’s death, which may not necessarily be the date they sustained fatal injuries. If you fail to file the lawsuit within this period, you will likely be unable to proceed with your claim or recover compensation.

It is important to point out the difference between a wrongful death claim and a survival claim. The latter is essentially a personal injury claim that survives the victim’s death, and it seeks compensation for damages that the deceased victim suffered as the result of another’s wrongful conduct before the death occurred. For example, the survival claim may seek compensation for the victim’s medical expenses, lost wages, and pain and suffering.

By pursuing just compensation, we aim to help you achieve a sense of closure and financial stability during this challenging time.
What Compensation Is Available in a Texas Wrongful Death Claim?
A wrongful death claim in Texas seeks to compensate a victim’s family members for the harm caused by the deceased’s death. Eligible beneficiaries of the deceased can agree how to distribute the proceeds from a wrongful death settlement or ask a court to do it. If a case goes to trial, a judge or jury will distribute the judgment. Two key factors will be the degree to which survivors were financially dependent on the deceased victim and the expenses incurred as a direct result of the accident and subsequent death.
Damages may include, but are not limited to, the following:
- Funeral and burial expenses
- Loss of the deceased victim’s financial support
- Loss of the deceased victim’s services
- Loss of inheritance
- Mental anguish
- Punitive damages (in exceptional cases where a willful act or omission or gross negligence causes the death)
